TERMS OF SERVICE

1. ABOUT THESE TERMS

These Terms of Service govern access to cassdenandco.com and purchases from the Cassden & Co online store.

The seller is COMPAÑÍA BALLENITA 98, S.L., NIF B81983686, trading as Cassden & Co. Full company, contact and registration details are available in our Legal Notice.

By placing an order, you agree to the version of these Terms and the applicable policies made available before checkout.

If you are a consumer, nothing in these Terms excludes or limits any mandatory consumer right.

1. ELIGIBILITY AND ACCOUNTS

You must have the legal capacity to enter into a purchase contract or act with the authorisation of a parent, guardian or legal representative.

You are responsible for providing accurate and current information and for keeping any account credentials confidential.

Please contact us promptly if you suspect unauthorised use of your account. Guest checkout may be available.

1. PRODUCT INFORMATION AND SAFETY

We aim to describe and display products accurately. Images may show minor differences in colour caused by screens, lighting or photography.

Material characteristics, dimensions, compatibility, ingredients, intended use, warnings, care instructions and safety information displayed for a product form part of the pre-contract information.

You must follow all labels, instructions and safety warnings supplied with a product.

Contact support@cassdenandco.com to report a safety concern, accident, missing warning or suspected unsafe product. Where required, we may contact customers and take corrective action, including product withdrawal or recall.

1. PRICES, TAXES AND PROMOTIONS

The total price, applicable taxes, shipping charges and any other mandatory charge payable by the customer will be displayed before the order is placed.

Prices may change prospectively, but a change will not affect an order already accepted.

Obvious technical or pricing errors may be corrected before an order is accepted. If payment has been collected for an order that cannot lawfully be fulfilled at the erroneous price, the amount collected will be refunded promptly.

Promotional codes and offers are subject to their stated conditions and validity periods.

When a price reduction is announced, the reference price will be determined and displayed in accordance with applicable law, including rules requiring the lowest prior price during the relevant 30-day period.

1. ORDERS AND CONTRACT FORMATION

Products displayed on the website are invitations to place an order and remain subject to availability.

After an order is submitted, we will send an electronic acknowledgement. This acknowledgement confirms receipt of the order but does not necessarily constitute acceptance.

Unless mandatory law provides otherwise, the sales contract is accepted when we expressly confirm acceptance or dispatch the product.

We may reject or cancel an order for a legitimate reason, including product unavailability, payment failure, suspected fraud, legal or safety restrictions, an incorrect delivery destination or an obvious technical error.

Any payment collected for a cancelled item will be refunded promptly.

1. PAYMENT

The payment methods available for an order are displayed at checkout and may be provided by regulated third-party payment providers.

By placing an order, you authorise the amount shown at checkout to be charged using the selected payment method.

We do not add optional paid services through pre-selected boxes.

Payment and fraud-prevention checks may require limited processing of personal data as explained in our Privacy Policy.

1. SHIPPING AND DELIVERY

Available destinations, delivery methods, shipping costs, estimated delivery periods, separate parcels, tracking and import arrangements are described in our Shipping Policy and in the information shown before purchase.

Products in one order may be fulfilled from different locations and arrive in separate parcels.

Cassden & Co remains responsible to the customer for the contracted delivery even when a supplier, carrier or fulfilment provider performs part of the service.

Unless a different period has been expressly agreed, delivery will take place no later than 30 calendar days after the contract is concluded, subject to applicable consumer law.

1. CANCELLATION, WITHDRAWAL AND RETURNS

Eligible consumers have a 14-calendar-day right of withdrawal from distance purchases, subject to applicable legal exceptions.

Cancellation before dispatch, withdrawal procedures, authorised return addresses, return costs, exceptions and refunds are described in our Return and Refund Policy, which forms part of these Terms.

Products must not be returned to a supplier, manufacturer, registered office or address shown on a parcel without following the return instructions provided by support@cassdenandco.com.

Any self-service return or cancellation tool offered by Shopify is an additional channel and does not restrict statutory rights.

1. LEGAL GUARANTEE AND REMEDIES

Goods must conform to the sales contract.

Where a lack of conformity exists, consumers may obtain the remedies required by applicable law. These may include repair, replacement, price reduction or termination of the contract and refund.

For goods sold by a Spanish trader, the current statutory conformity period for new goods is three years. Consumers in other countries retain any mandatory local rights that also apply.

Remedies required by law are provided free of charge. Any commercial warranty is additional and does not replace the legal guarantee.

1. ACCEPTABLE WEBSITE USE

You must not:

• Use the website unlawfully or fraudulently.

• Interfere with its operation or security.

• Introduce malicious code or harmful material.

• Attempt unauthorised access to accounts, systems or data.

• Scrape, reproduce or commercially exploit content unlawfully.

• Infringe intellectual-property, privacy or other third-party rights.

We may restrict abusive or unlawful access where reasonably necessary to protect the store and its users, subject to applicable law.

1. INTELLECTUAL PROPERTY

The Cassden & Co name, logos, website design, photographs, text, graphics and original content are owned by or licensed to COMPAÑÍA BALLENITA 98, S.L.

A limited, revocable and non-transferable permission is granted solely to access and use the store for personal and lawful shopping purposes.

No ownership right is transferred. Content may not be reproduced, distributed, transformed, publicly communicated or commercially exploited without prior written permission, except where permitted by law.

Third-party trademarks and content remain the property of their respective owners.

1. REVIEWS AND USER CONTENT

If you submit a product review, photograph, comment or other content, it must be accurate, lawful and must not infringe the rights of another person.

You grant us a non-exclusive licence to display and use that content for operating and promoting the store, subject to applicable privacy and consumer law.

We may remove content that is unlawful, abusive, misleading, irrelevant or infringes third-party rights. We will not manipulate or misrepresent genuine consumer reviews.

1. THIRD-PARTY SERVICES AND LINKS

The store may use Shopify and third-party payment, analytics, communication, fulfilment and delivery services.

Their operation may be governed by additional terms or privacy notices where they act independently.

External links are provided for convenience and do not imply endorsement. We remain responsible for the obligations that consumer law places on us as seller.

1. LIABILITY

Nothing in these Terms excludes or limits liability for:

• Fraud or wilful misconduct.

• Death or personal injury caused by negligence.

• Defective or unsafe products.

• Breach of mandatory consumer law.

• Any other liability that cannot lawfully be excluded.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was made or for business losses suffered by a person acting outside the legal definition of a consumer.

Nothing in this section removes any statutory remedy relating to goods, payment, delivery, privacy or product safety.

1. PRIVACY AND COOKIES

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.

Non-essential cookies and similar technologies are used only in accordance with the consent choices and settings described in our Cookie Policy and cookie banner.

1. CHANGES TO THESE TERMS

We may update these Terms prospectively for legal, technical or operational reasons.

The version applicable to an order is the version made available before that order was placed.

Material changes do not retroactively reduce existing contractual or consumer rights.

1. GOVERNING LAW AND DISPUTES

Spanish law applies, without depriving consumers of mandatory protection granted by the law of their habitual residence.

Courts are determined by mandatory jurisdiction and consumer-protection rules. No provision requires a consumer to litigate exclusively in Toledo.

Please contact support@cassdenandco.com first so that we can attempt to resolve any complaint.

Consumers may also contact a competent consumer-protection authority or an available alternative dispute-resolution body where applicable.
